Welcome to Aimee Molien's website. These Terms of Service ("Terms") govern your use of my website and services. By accessing this website or purchasing my services, you agree to be bound by these Terms.

  • "You," "your," "client" refers to you, the user of this website, or purchaser of services

  • "Services" refers to coaching, consulting, workshops, training programs, DISC assessments, keynote speaking, and any other services I offer

  • "Content" refers to all text, images, videos, audio, documents, and other materials on this website


SERVICES OFFERED

I provide leadership development, AI integration consulting, DISC assessments, executive coaching, workshops, corporate training programs, and keynote speaking services.


My services include, but are not limited to:

Specific details, pricing, and terms for each service are provided at the time of purchase or booking.

COACHING AND CONSULTING DISCLAIMER

Not Therapy, Medical, or Legal Advice


My services are educational and developmental. I am a certified coach (ICF ACC), certified leadership trainer (John Maxwell Team), and certified DISC consultant, not a licensed therapist, psychologist, psychiatrist, medical doctor, or attorney.


My services do not include and are not a substitute for:

  • Psychotherapy or mental health treatment

  • Medical diagnosis or treatment

  • Legal advice

  • Financial or investment advice

  • Any other licensed professional services

 

If you are experiencing:

  • Mental health issues (depression, anxiety, trauma, etc.)

  • Medical conditions

  • Legal problems

  • Financial difficulties requiring professional advice

 

Please seek appropriate licensed professionals. I am happy to provide referrals when appropriate.

 

No Guarantees of Results
While I am committed to providing high-quality coaching, training, and consulting services, I cannot and do not guarantee specific results.


Your success depends on many factors, including but not limited to:

  • Your commitment and effort

  • Your implementation of the strategies discussed

  • Your specific circumstances

  • External factors beyond either of our control

 

Testimonials and examples on this website represent individual experiences and are not guarantees of future results. Your results may vary.


Your Responsibility

BOOKING AND PAYMENT TERMS

Booking Services
When you book a service through my website (via Calendly, contact form, or other means), you are entering into a binding agreement to purchase that service under these Terms.


Payment
Payment Methods:
I accept payment via credit card, debit card, and other methods available through my payment processors (Stripe, Square, or PayPal).

 

When Payment Is Due:

  • DISC Debriefs: Payment due at time of booking

  • Workshops: Payment due at time of registration

  • Executive Coaching: 50% deposit to secure your spot, remaining 50% due at start of engagement (or payment plan as agreed)

  • Corporate Programs: 50% deposit to secure dates, 50% due at program start (or as specified in proposal/contract)

  • Keynote Speaking: 50% deposit to secure date, 50% due before event (or as specified in speaker agreement)

 

Payment Plans:
If a payment plan is offered and agreed upon, you must make all payments on time according to the agreed schedule. Failure to make timely payments may result in suspension or termination of services.

 

Pricing
All prices are listed in US dollars (USD) unless otherwise specified. I reserve the right to change pricing at any time. Price changes will not affect services already purchased or booked.

 

Taxes
You are responsible for any applicable taxes, duties, or other governmental fees associated with your purchase. I will collect sales tax where required by law.

 

CANCELLATION AND REFUND POLICY

DISC Assessment Debriefs
Cancellation/Rescheduling:

  • 48+ hours notice: Reschedule for free or full refund minus $25 administrative fee

  • Less than 48 hours notice: $50 rescheduling fee or forfeit 50% of payment

  • No-show: No refund

 

Refunds:

If you cancel before taking the DISC assessment: Full refund minus $25 administrative fee
If you cancel after taking the assessment but before the debrief: 50% refund (assessment cost is non-refundable)


Workshops (Leadership Labs, Ministry Workshops)
Cancellation by You:

  • 14+ days before workshop: Full refund minus $50 administrative fee

  • 7-13 days before workshop: 50% refund OR transfer to future workshop

  • Less than 7 days before workshop: No refund, but you may transfer registration to a future workshop (one transfer allowed)

  • No-show: No refund, no transfer

 

Cancellation by Me:

  • If I must cancel a workshop due to illness, emergency, or insufficient enrollment:

  • You will receive a full refund OR

  • You may transfer to the next available workshop

  • I am not responsible for any travel or other expenses you may have incurred

 

Rescheduling:
If I must reschedule a workshop, you will be notified as soon as possible and given the option to attend the rescheduled date or receive a full refund.

Executive Coaching
Cancellation Before Coaching Begins:

  • If you cancel before the first session: Full refund minus $250 administrative fee (covers assessment and onboarding time)

  • If you paid a deposit: Deposit is non-refundable after 7 days

Cancellation During Coaching Engagement:

  • Coaching packages are non-refundable once the engagement has begun

  • If you must discontinue for extraordinary circumstances (medical emergency, etc.), contact me to discuss options on a case-by-case basis

 

Rescheduling Individual Sessions:

  • 48+ hours notice: Reschedule for free

  • 24-48 hours notice: Session may be rescheduled once; repeated late cancellations may result in forfeiture

  • Less than 24 hours notice or no-show: Session is forfeited with no makeup or refund


Corporate Programs and Team Workshops

  • Cancellation by Client Organization:

  • 30+ days before program start: Full refund minus deposit (deposit is non-refundable)

  • 15-29 days before program start: 50% refund

  • Less than 15 days before program start: No refund

 

Rescheduling:
Programs may be rescheduled with 30+ days notice at no additional charge (subject to my availability). Less than 30 days notice may incur rescheduling fees.


Scope Changes:
Any changes to program scope, participant count, or deliverables after contract signing may result in adjusted pricing.

 

Keynote Speaking
Cancellation by Event Organizer:

  • 60+ days before event: Full refund minus deposit (deposit is non-refundable)

  • 30-59 days before event: 50% refund

  • Less than 30 days before the event: No refund

 

Cancellation by Me:
If I must cancel due to illness or emergency, I will:

  • Provide as much notice as possible

  • Refund all payments in full OR

  • Offer a replacement date or a qualified substitute speaker (with your approval)

  • I am not responsible for event costs, lost revenue, or other damages


How to Request Cancellation or Refund
To cancel a service or request a refund, email me at aimee@aimeemolien.com with:

  • Your name

  • Service purchased

  • Date of service

  • Reason for cancellation (optional but helpful)

I will respond within three business days. Refunds will be processed within 10 business days to your original payment method.

 

INTELLECTUAL PROPERTY

My Content
All content on this website and in my services, including but not limited to text, graphics, logos, images, audio, video, worksheets, assessments, slide decks, curriculum, frameworks, and other materials, is owned by me (Aimee Molien) or my licensors and is protected by copyright, trademark, and other intellectual property laws.


You may not:

  • Copy, reproduce, or distribute my content without written permission

  • Modify, adapt, or create derivative works from my content

  • Use my content for commercial purposes without a license

  • Remove copyright or trademark notices from my materials

  • Claim my content as your own

You may:

  • View and download content for your personal, non-commercial use

  • Print worksheets and materials provided for your own development

  • Share links to my website (but do not copy the content)

  • Quote brief excerpts with proper attribution (e.g., "According to Aimee Molien...")

Workshop and Coaching Materials
When you purchase a workshop or coaching engagement, you receive a limited, personal, non-transferable license to use the materials provided for your own professional development.


You may not:

  • Share materials with others who did not purchase the service

  • Use materials to train others (unless you have a train-the-trainer license)

  • Resell or distribute materials

  • Post materials online or in shared drives accessible to non-purchasers

Violation of these terms may result in termination of services without refund and potential legal action.


Your Content
If you submit content to me (testimonials, feedback, questions, etc.), you grant me a non-exclusive, royalty-free, perpetual license to use that content for marketing and promotional purposes. I will not share content that identifies you without your permission.


Third-Party Content
Some content on my website may be licensed from third parties (e.g., John Maxwell Team content, DISC assessment materials, stock photos). These materials are subject to their respective owners' terms and conditions.

CONFIDENTIALITY

My Commitment to You
I treat all information shared during coaching, consulting, and training engagements as confidential. I will not disclose your personal information, business information, or the content of our sessions to third parties without your consent, except:

  • When required by law

  • When necessary to prevent harm to you or others

  • When using anonymized information for case studies or examples (with details changed to protect your identity)

  • When working with my own coach, supervisor, or professional advisors (who are also bound by confidentiality)

Your Commitment
If you participate in group programs (workshops, cohorts, corporate programs), you agree to:

  • Keep all information shared by other participants confidential

  • Do not disclose the identities of other participants outside the group

  • Create a safe space for open discussion

  • Respect the privacy and boundaries of others

Violating group confidentiality may result in removal from the program without a refund.


Limits of Confidentiality
I am not bound by therapist-client privilege or attorney-client privilege. In certain circumstances, I may be legally required to disclose information (e.g., a court order or a threat of harm).

RECORDING AND PHOTOGRAPHY

My Recording
I may record virtual sessions (coaching calls, workshops, webinars) for:

  • Quality assurance and improvement

  • Providing you with a replay

  • Training purposes (with identifying information removed)

If you do not wish to be recorded, please notify me in advance.


Your Recording
You may not record sessions (audio or video) without my explicit written permission. This includes coaching calls, workshops, webinars, and any other interactions.


Photography and Testimonials
If you participate in an in-person event, I may take photographs or videos for promotional purposes. If you prefer not to be photographed, please let me know.


I may request testimonials from you after services. You are never obligated to provide a testimonial. If you do provide one, you grant me permission to use it on my website, social media, and marketing materials.

LIMITATION OF LIABILITY

Disclaimer of Warranties
My website and services are provided "as is" and "as available" without warranties of any kind, either express or implied.
I do not warrant that:

  • My website will be uninterrupted, error-free, or secure

  • Any errors will be corrected

  • My services will meet your specific expectations or requirements

  • Results from my services will be achieved

Limitation of Damages
To the maximum extent permitted by law:
I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities

  • Loss of data or information

  • Personal injury or property damage

  • Emotional distress

My total liability to you for any claim arising from these Terms or my services shall not exceed the amount you paid me for the specific service giving rise to the claim.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Aimee Molien and any affiliates, contractors, or agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms

  • Your violation of any third-party rights

  • Any content you submit to me

DISPUTE RESOLUTION

Informal Resolution
If you have a dispute or complaint regarding my services, please contact me at aimee@aimeemolien.com. I am committed to resolving issues fairly and promptly. Most concerns can be resolved through direct communication.


Mediation
If we cannot resolve a dispute informally, we agree to attempt mediation before pursuing arbitration or litigation. Mediation will be conducted by a mutually agreed-upon mediator in Abilene, Texas, or virtually.


Arbitration
If mediation is unsuccessful, any dispute arising from these Terms or my services shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in Abilene, Texas, or virtually.
You agree to waive your right to a jury trial and to participate in a class action lawsuit.


Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.


Jurisdiction
For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in the United States, Texas.

WEBSITE USE

Acceptable Use
When using my website, you agree not to:

  • Use the website for any unlawful purpose

  • Attempt to gain unauthorized access to any part of the website

  • Interfere with or disrupt the website or servers

Termination by Me

  • Conduct that I determine is harmful to me, other clients, or my business

  • Requests for services outside my scope of practice

  • Circumstances where I believe the coaching/consulting relationship is no longer productive

If I terminate services due to your violation of these Terms or inappropriate conduct, you will not receive a refund.


If I terminate services for other reasons (e.g., I determine I'm not the right fit for your needs), I will provide a prorated refund for unused services.


Effect of Termination
Upon termination:

  • Your right to use my website and services ends immediately

  • You must stop using any materials provided to you

  • Provisions that should survive termination (confidentiality, intellectual property, limitation of liability, indemnification, dispute resolution) will remain in effect


CHANGES TO THESE TERMS

I may update these Terms from time to time. When I make changes:

  • I'll update the "Last Updated" date at the top

  • For significant changes, I may notify you by email or a prominent notice on my website

  • Continued use of my website or services after changes constitutes acceptance of the new Terms

SEVERABILITY
